Agreement to Terms

By downloading, installing, or using the PausePath mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and PausePath ("we," "our," or "us").

Description of Service

PausePath is a behavior-change tool designed to help users interrupt compulsive scrolling and make more intentional choices about their digital habits. The App provides features such as intervention prompts, usage insights, challenges, and community features.

Not Medical Advice

PausePath is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is intended solely as a general wellness and behavior-change tool. It is not a substitute for professional medical advice, mental health treatment, or therapy. If you have concerns about your mental health, digital addiction, or any other health-related issues, please consult a qualified healthcare professional. We make no representations or warranties regarding the effectiveness of the App for any particular purpose.

User Accounts

To use certain features of the App, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if we suspect unauthorized use or violation of these Terms.

User Content and Conduct

The App may allow you to create, post, or share content, including posts, comments, group messages, and challenge activity ("User Content"). You are solely responsible for your User Content and the consequences of posting or sharing it.

By posting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with operating and improving the App.

Prohibited Conduct

You agree not to use the App to:

  • Post or share content that is harassing, abusive, threatening, defamatory, or discriminatory
  • Engage in bullying, intimidation, or targeted attacks against other users
  • Post illegal content or content that promotes illegal activities
  • Share content that is sexually explicit, violent, or otherwise harmful
  • Impersonate another person or entity
  • Spam, advertise, or solicit without authorization
  • Attempt to access other users' accounts or personal information
  • Interfere with or disrupt the App or its servers
  • Use the App for any purpose that is unlawful or prohibited by these Terms

We reserve the right to remove any User Content and to suspend or terminate accounts that violate these Terms, at our sole discretion.

Subscriptions and Payments

PausePath may offer premium features available through paid subscriptions. All subscriptions and in-app purchases are processed exclusively through Apple In-App Purchase via the App Store.

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • You can manage and cancel your subscription in your App Store account settings
  • Refund requests must be submitted through Apple according to their policies

We are not responsible for any issues related to payment processing handled by Apple.

Intellectual Property

The App and its original content, features, and functionality are owned by PausePath and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAUSEPATH, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.

Indemnification

You agree to indemnify, defend, and hold harmless PausePath and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PausePath operates, without regard to its conflict of law provisions.
